Marijuana’s legalization has been a slow but ongoing process throughout the United States, with a number of states offering medical marijuana, and several that have moved to fully legalize recreational use. Laws regarding marijuana’s use are changing at a rapid pace across all 50 states, which can make it a bit confusing to keep up.
Today, 37 states have allowed for the use of medical marijuana, while 18 states have allowed for full recreational use. Each state governs its own legality regarding marijuana use, however it’s still illegal on a federal level which can create a gray area of confusion. One area that quickly becomes a head scratcher is travel across state lines. Before you travel, keep in mind the following items:
Flying With A Medical Marijuana Card
As of today, air travel is still governed by Federal law, meaning it’s still illegal to fly with nearly all medical marijuana products—the only exception being CBD products which are permitted in carry-on and checked bags. The state you’re flying to or from does not have any impact on its legality.
Traveling By Train With A Medical Marijuana Card
Currently, the only passenger railroad service that provides scheduled long-distance travel between cities is Amtrak. All Amtrak stations, buses, and trains prohibit the transportation of marijuana regardless of the state.
